By utilizing the TradeWatch Service, you recognize and consent to the collection, storage, use, disclosure, and other utilization of your Personal Data by TradeWatch in accordance with this Privacy Policy. Processing your Personal Data is crucial for fulfilling our contractual obligations to you, providing our Service to you as per the TradeWatch Terms and Conditions you have agreed to, and addressing our business needs.

When you enter into a contract with us for the use of the TradeWatch Service – We process your data on our own behalf, to the extent necessary for the conclusion and execution of this contract. Without this data, we would be unable to provide the Service, and you would be unable to utilize it. Not providing such data will hinder the conclusion and execution of the contract (legal basis: Article 6(1)(b) GDPR).
By entering into a contract with us for the use of the TradeWatch Service on behalf of and for the benefit of an Organization – We process your data based on a legitimate interest as defined by Article 6(1)(f) of the GDPR. This interest is our fulfillment of rights and obligations under that contract. Without this, we could not deliver the service to the Organization you represent, nor could the Organization utilize the service.
When you use the TradeWatch Service as an End User – We process your data based on a legitimate interest as per Article 6(1)(f) of the GDPR. This interest is our execution of rights and obligations under the contract, for the benefit of the Customer you represent and on whose behalf you use the TradeWatch Service. Providing your personal data may be a business requirement or necessary for the Customer to fully benefit from the services provided by the TradeWatch Service.

Legitimate interests of the Administrator include:

Ensuring the security of the service (e.g., verifying that no unauthorized individual accesses your account)
Conducting statistical analyses, enhancing our services, and adapting them to your preferences and convenience (e.g., personalizing content on services),
Direct marketing or promoting our services,
Asserting, safeguarding, or defending against claims.

To initiate and fulfill the contract established with you, or the Customer you represent or benefit from while using the TradeWatch Service, and thus deliver the services via the TradeWatch Service, we require the provision of the following personal data:

Identifying information – This includes, but is not limited to, your first and last name, which we utilize to confirm your identity.

Contact information – This encompasses, but is not limited to your email address, and other communication channels you employ to reach out to us for further information. We use this information to authenticate you as our User and to communicate with you for various purposes, depending on the need.

TradeWatch may also collect the following categories of data:

Device information – This covers a range of data, including information about your devices or browsers, which reflects your online activities or device usage. System-collected information about your devices and cookie tags and pixels-collected information about your browsers are integral, often for network security reasons. This encompasses, but is not limited to, your IP address, the date and time of your access to the System, the duration of your visit, the volume of data transferred, the referring URL (if you arrived at our website from another site or via an advertisement), the pages you visited on our website, your browser type (including language and software version), browser add-ons, device ID and features, device type and version, and operating system.

Recipients of Personal Data

The entities that may receive your personal data include:

Service providers offering necessary technical and organizational solutions for the Administrator (e.g., IT service providers, maintenance service providers).

Data Retention

Processing Period: Your data is processed as long as you utilize the TradeWatch Service. If you cease using our services without requesting data deletion, we will retain it until your account on the TradeWatch Service is terminated.

Retention Period: Upon termination of your account, all your data held by TradeWatch will be deleted, except for data necessary for TradeWatch to fulfill legal obligations and meet statutory limitation periods. The data retained will be minimized as much as necessary and stored no longer than the end of the calendar year in which the longest limitation period for potential civil contractual or tort liability claims related to the cooperation within the TradeWatch Service expires, as allowed by applicable law.

Your Rights

Withdrawal of Consent: You can withdraw your consent for future processing at any time in cases where your consent is required. This does not affect the lawfulness of processing based on consent before its withdrawal. In some instances, we may continue processing your data after withdrawal if there’s another legal basis or if the withdrawal was limited to certain processing activities.
